AstraZeneca and its subsidiaries, together with other major drug makers, are filing lawsuits against the U. S. Food and Drug Administration, alleging the companies were misusing evidence to justify their drug uses, which have been cited for possible dangerous side effects.
The lawsuit claims Nexium and its generic equivalent esomeprazole, which is sold under the brand name Nexium, have caused heartburn and acid reflux in children. The drugs belong to a class of drugs known as proton pump inhibitors, or PPIs.
“The FDA is the original, and the drug makers all deserve their fair share of the money,” said Janet Woodcock, director of the FDA’s Center for Drug Evaluation and Research.
The lawsuit is filed in federal court in San Francisco, California.
In May, the FDA issued a public statement warning consumers not to take the drugs if they had taken the drug for more than a year and a half.
The FDA has already issued a warning letter for the two PPIs, in a report in September. The FDA says it has found no evidence that the drugs are linked to serious heartburn and acid reflux.
The warnings also apply to the drugs in all but one of the Nexium lawsuits. The other PPIs, in all but one of the cases, are the heartburn drugs Actavis and Actos.
The lawsuits claim the FDA was “reviewing the literature and finding no evidence of a relationship between the drugs and heartburn,” which is a serious condition.
A spokesman for AstraZeneca said the agency has completed a review of the evidence, and in June it issued a statement saying the drugs “were not safe for children under the age of 18.”
“If your child has taken a heartburn drug that may cause serious side effects, we urge parents to seek medical advice from their doctor immediately,” a spokesman said.
“The FDA has made a strong recommendation to patients to avoid any drugs that may cause serious side effects,” he said. “It’s important for consumers to be aware of the risks of this medicine.”
The lawsuit also claims the drugs are not safe for people taking other PPIs, including esomeprazole. The company also said it has found no evidence that the drugs are linked to heartburn.
The FDA said there is no evidence the drugs were linked to heartburn, but it said the companies have been found to have failed to adequately warn consumers of the increased risk.
“We are concerned that the companies may have caused serious harm to children,” a spokesperson said.
“We are also concerned that the drugs may have caused serious side effects in children. However, there is no evidence that this is a direct cause of the side effects,” the spokesman said.
The company declined to disclose how much the drugs were prescribed for.
In October, the company posted a warning for the drugs in the U. but the agency said it found no evidence it caused serious harm to children.
“This letter is to inform parents and patients of the dangers associated with the drug,” the company said in a statement.
